Terms and Conditions of Sale

These Terms and Conditions of Sale define the rights and obligations of the parties in the context of the sale of services offered by NexaWP Manager, published by JR Web Concept. Any subscription implies unreserved acceptance of these Terms. The Customer acknowledges having read the Terms before placing an order.

NexaWP Manager is a SaaS (Software as a Service) platform for centralized WordPress site management. The service includes: • Unlimited WordPress site management • Real-time monitoring (availability, response time) • Centralized updates (plugins, themes, WordPress) • Plugin rollback • WordPress user management • Custom notes and tags • Maintenance reports (coming soon) • Automatic backups (coming soon) Access to the service is via the web application app.nexawpmanager.com after creating a user account.

The monthly subscription price is €19.90 including VAT. This price includes access to all service features with no limit on the number of WordPress sites managed. Prices may be changed at any time. In case of modification, the Customer will be informed by email at least 30 days before the new rates apply. The Customer may cancel their subscription before the new prices take effect.

NexaWP Manager offers a 7-day free trial period to test all service features. No credit card is required during this period. At the end of 7 days, the Customer must subscribe to a paid plan to continue using the service. Without subscription, the account will be automatically suspended.

Payment is made by credit card via our secure payment provider Stripe. The subscription is billed monthly, on the anniversary date of subscription. Payment is due immediately on the due date. In case of payment failure, the Customer has 7 days to regularize the situation. After this period, access to the service will be suspended.

The subscription is for an indefinite period with monthly billing. The Customer may cancel their subscription at any time from their personal space, without fees or penalties. Cancellation takes effect at the end of the current monthly period. The Customer retains access to the service until that date. No pro-rata refund is made for the remaining period. NexaWP Manager reserves the right to terminate a Customer's subscription in case of violation of these Terms, with 15 days notice except in case of serious breach.

In accordance with consumer protection laws, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium whose execution has begun with the prior express consent of the consumer. By accepting these Terms and starting to use the service, the Customer expressly waives their right of withdrawal. However, the 7-day free trial period allows testing the service without commitment.

The Customer agrees to: • Provide accurate information during registration • Maintain the confidentiality of their login credentials • Use the service in accordance with its intended purpose • Not use the service for illegal or fraudulent purposes • Respect intellectual property rights • Ensure that connected WordPress sites belong to them or that they have the necessary authorizations

NexaWP Manager commits to implementing all necessary means to ensure service continuity and quality. This is an obligation of means, not results. NexaWP Manager cannot be held liable for: • Temporary service interruptions for maintenance • Damages resulting from misuse of the service by the Customer • Data loss related to failure of the Customer's WordPress sites • Consequences of an update performed by the Customer via the platform In any case, NexaWP Manager's liability is limited to the amounts paid by the Customer during the last 12 months.

NexaWP Manager guarantees: • 99.9% service availability on a monthly basis (excluding scheduled maintenance) • Data security in accordance with industry standards • Technical support by email with a 24-hour business day response time These guarantees do not cover malfunctions related to external factors (Customer site hosting, third-party plugins, etc.).

In case of dispute, the Customer is invited to contact customer service at hello(a)nexawpmanager.com to seek an amicable solution. In accordance with consumer protection laws, the consumer Customer may use the mediation service offered by NexaWP Manager free of charge. The mediator may be contacted within one year of the written complaint sent to customer service. These Terms are governed by French law. In case of dispute not resolved amicably or through mediation, French courts shall have sole jurisdiction, subject to territorial jurisdiction rules applicable to consumers.
